General terms and conditions of sale

The present terms and conditions of sale are concluded on the one hand by SAS Nuts and Bolts Development with a share capital of 10,000€, whose registered office is located at 29 rue Poul Er Vran 56400, Auray – FRANCE, registered with the Lorient Trade and Companies Register under number 812 607 844, hereinafter referred to as “Nuts & Bolts” and which manages the nutsandbolts-france website. com and, on the other hand, by any individual or legal entity wishing to make a purchase via the “nutsandbolts-france.com” website, hereinafter referred to as “the buyer”.

Article 1. Subject

The present conditions of sale aim to define the contractual relation ship between Nuts & Bolts and the buyer and the conditions applicable to any purchase made through the “nutsandbolts-france.com” website. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the “nutsandbolts-france.com” site is not directly related to his professional activity and is limited to strictly personal use and, on the other hand, that he has full legal capacity, allowing him to commit himself under the present general conditions of sale.

SAS Nuts and Bolts Development reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its site. As a result, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those that appear on the nutsandbolts-france.com website of the company Nuts & Bolts, within the limits of available stocks. The company Nuts & Bolts reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on the Seller. The sale of the products presented on the nutsandbolts-france.com website is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Prices

The prices appearing on the product sheets in the internet catalogue and are prices in Euros (€) exclusive of tax (HT) and all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. Nuts & Bolts reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only one applicable to the purchaser. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order.

Article 4. Order and terms of payment 

Before placing an order, the buyer must create an account on the nutsandbolts-france.com website. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile…), must identify himself using this information. The company Nuts & Bolts offers the buyer the possibility of ordering and paying for his products in several stages, with 3 payment options to choose from:

  • Payment by bank transfer :

The buyer selects the products he wishes to order in the “basket”, modifies if necessary (quantities, references…), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: “Payment by bank transfer”. Finally, the last step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, then invites the buyer to confirm his order by clicking on the “Confirm my order” button. This last click constitutes the definitive conclusion of the contract. As soon as the order has been confirmed, the buyer receives an order form confirming the registration of his/her order. In order to finalise his payment and trigger the processing of his order, the purchaser must contact his bank in order to make the transfer corresponding to the amount of his order to the bank account of Nuts & Bolts, whose details are communicated to the purchaser. As soon as the transfer is received, the order will be processed and the buyer will be informed by e-mail. Nuts & Bolts will dispatch the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.

  • Secure payment by PayPal or credit card (via the PAYPAL system)

The buyer selects the products he wishes to order in the “basket”, modifies if necessary (quantities, references…), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the method of payment of his choice: “Payment by PayPal”. The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, then invites the buyer to confirm his order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the secure PAYPAL interface in order to securely enter his PayPal account or personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by PayPal account or credit card is irrevocable. In the event of fraudulent use of the latter, the buyer may demand the cancellation of the card payment, the sums paid will then be recredited or refunded. The responsibility of the credit card holder is not engaged if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. In order to obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must contest the debit in writing with his bank within 70 days of the transaction, or 120 days if the contract binding him to the bank so provides. The amounts debited are reimbursed by the bank within a maximum period of one month after receipt of the written objection from the cardholder. The holder may not be charged for any costs incurred in returning the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, the acknowledgement of having perfect knowledge of them and the renunciation of the right to avail oneself of one’s own terms and conditions of purchase. All the data provided and the recorded confirmation will serve as proof of the transaction. If the purchaser has an e-mail address and has provided it on the order form, Nuts & Bolts will send him/her by e-mail confirmation of the registration of his/her order.

Article 5. Retention of title

The company Nuts & Bolts retains full and complete ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal

Insofar as the purchaser is a consumer (§ 13 Civil Code, BGB), he has the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which the buyer or a third party appointed by him and not being the carrier, has taken delivery of the last goods. In order to exercise this right of withdrawal, the purchaser must inform us, by means of an unequivocal notification by post with acknowledgement of receipt or by e-mail, of his decision to withdraw from this contract at the following addresses

. He may use the standard withdrawal form attached, which is not, however, obligatory. The withdrawal period shall be deemed to have been observed if the purchaser sends his notice of withdrawal before the expiry of the required period.

  • Consequences of withdrawal

If the buyer withdraws from this contract, we are obliged to refund without delay, at the latest within fourteen days of the day on which we received the notice of withdrawal from this contract, all payments, including shipping costs (except for additional costs resulting from the fact that the buyer has requested a method of delivery other than the cheapest standard delivery we offer) that we have received from the buyer. For this refund, we use the same method of payment as that used by the buyer in the original transaction, unless expressly agreed otherwise; under no circumstances will costs be charged to the buyer in connection with the refund. We may refuse the refund until we have taken possession of the goods or, whichever is the earlier, until the buyer provides proof that the goods have been returned. In any case, the purchaser is obliged to return or hand over the goods to us at the latest within fourteen days of the day on which he has notified us of his withdrawal from the contract. This deadline is complied with if the purchaser dispatches the goods before expiry of the fourteen-day period. We shall bear the costs of returning the goods. The buyer shall only be liable for any depreciation of the goods resulting from handling other than that necessary to ensure the nature and proper functioning of the goods.

  • Exclusion of the right of withdrawal

The right of withdrawal does not apply in the case of

  • delivery of goods that are not prefabricated and made to the consumer’s specifications or explicitly to meet the consumer’s personal needs,
  • livraison de marchandises scellées ne pouvant, pour des raisons d’hygiène ou de protection de la santé, être retournées dès lors qu’elles ont été descellées après livraison.
  • delivery of sealed goods which for reasons of hygiene or health protection cannot be returned as soon as they have been unsealed after delivery.
  • delivery of newspapers, periodicals or illustrations, with the exception of subscription contracts.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are made by UPS (see the general terms and conditions of transport UPS), delivery service with tracking, delivery with signature. Delivery times are only given as an indication; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The company Nuts & Bolts may provide the buyer with the tracking number of his package by e-mail. The buyer will be delivered to his/her home by UPS delivery service. If the buyer is absent, he will receive a delivery notice from his postman, allowing him to collect the products ordered from the nearest post office, during a period indicated by the postal services. Transport risks are the responsibility of the purchaser from the moment the items leave the premises of the company Nuts & Bolts. The purchaser is obliged to check the condition of the packaging of the goods and their contents on delivery in the presence of the delivery person. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by the company Nuts & Bolts benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to Nuts & Bolts who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address: SAS Nuts and Bolts Development, 29 rue Poul Er Vran, 56400 Auray – FRANCE, within thirty days of delivery.

Article 9. Responsibility

The company Nuts & Bolts, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption or other involuntary problems.

Article 10. Intellectual Property 

All elements of the nutsandbolts-france.com website are and remain the exclusive intellectual property of the company Nuts & Bolts. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the site, whether in the form of photos, logos, visuals or text.

Article 11. Data of a personal nature

The company Nuts & Bolts undertakes to preserve the confidentiality of information provided by the purchaser, which he may be required to transmit for the use of certain services. Any information concerning him/her is subject to the provisions of law n° 78-17 of 6 January 1978. As such, the Internet user has the right to access, modify and delete information concerning him/her. Article 12. Dispute resolution 

The present terms and conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be that of Lorient: 3 rue Benjamin Delessert, 56100 Lorient – France.
